1. Agreement to Terms

By downloading, installing, or using any HonestApps application ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

These Terms apply to all users of our Apps, including PokerPal, BreathingLoop, and any future applications published under the HonestApps name.

2. Description of Service

HonestApps provides mobile applications designed for personal use. Our Apps are provided "as is" and are intended for entertainment, utility, and personal productivity purposes.

• PokerPal: A home poker game tracking and settlement tool
• BreathingLoop: A guided breathing exercise application

3. Use of the Apps

Permitted Use

You may use our Apps for lawful, personal, non-commercial purposes. You agree to:

• Use the Apps in compliance with all applicable laws
• Not attempt to reverse engineer, decompile, or disassemble the Apps
• Not distribute, sell, or transfer your license to use the Apps
• Not use the Apps for any illegal gambling activities

PokerPal Specific Terms

PokerPal is designed for tracking friendly home poker games. By using PokerPal, you acknowledge that:

• You are responsible for ensuring compliance with local gambling laws in your jurisdiction
• HonestApps does not facilitate, encourage, or condone illegal gambling
• The App is a tracking tool only and does not provide gambling services
• All financial calculations are for informational purposes; verify settlements independently

4. In-App Purchases

Our Apps offer optional in-app purchases to remove advertisements. By making a purchase:

• You agree to pay all charges at the prices displayed at the time of purchase
• All purchases are processed by Apple through the App Store
• Purchases are final and non-refundable, except as required by applicable law
• Refund requests must be directed to Apple, not HonestApps

5. Advertisements

Free versions of our Apps display advertisements provided by Google AdMob. By using the free version, you consent to viewing these advertisements. You may remove ads through an in-app purchase.

6. Intellectual Property

All content, features, and functionality of our Apps—including but not limited to design, graphics, text, and code—are owned by HonestApps and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Apps for personal purposes only.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF INFORMATION

We do not warrant that the Apps will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONESTAPPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Loss of goodwill
• Financial losses from poker games tracked using PokerPal
• Any damages arising from reliance on information provided by the Apps

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless HonestApps and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Apps or violation of these Terms.

10. Termination

You may terminate your use of our Apps at any time by uninstalling them from your device. We reserve the right to terminate or suspend access to our Apps at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Apps after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HonestApps operates, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HonestApps regarding the use of our Apps.
